1. Acceptance of Terms

By accessing the FlexiTours platform and making a booking, you unconditionally accept these Terms of Service. If you do not accept these terms, please do not use our service. These terms apply to all persons using the site, whether as customers, guides, or visitors.

2. Service Description

FlexiTours is an online booking platform offering private guided tours and shuttle services in the province of Quebec, Canada. Each time slot is reserved for a single group, guaranteeing an exclusive experience. Partner guides are certified and operate independently; FlexiTours acts as an intermediary facilitating the connection.

3. Bookings and Payments

A booking is considered confirmed only upon receipt of full payment. Payments are processed securely via Stripe. Prices are displayed in Canadian dollars (CAD) and are subject to the Goods and Services Tax (GST — 5%) and the Quebec Sales Tax (QST — 9.975%) as applicable. A receipt detailing taxes collected will be sent to you by email.

4. Cancellation Policy

Cancellations made at least 48 hours before the scheduled tour date and time are eligible for a full refund. Cancellations made within 48 hours of departure are non-refundable. In the event of cancellation on our part due to circumstances beyond our control (extreme weather, force majeure), a full refund or rescheduling will be offered.

5. Customer Responsibilities

The customer agrees to:

- Provide accurate information at the time of booking (number of participants, relevant medical restrictions, etc.). - Arrive at the meeting point at the time indicated in the confirmation. - Follow the guide's safety instructions throughout the tour. - Not arrive intoxicated or under the influence of substances that could endanger the group.

FlexiTours reserves the right to refuse or interrupt a tour if a participant's behavior poses a safety risk, without any obligation to issue a refund.

6. Limitation of Liability

FlexiTours shall not be liable for indirect, incidental, or consequential damages arising from the use of our services. Our liability is limited to the amount paid for the booking in question. We recommend that customers obtain appropriate travel insurance. Outdoor activities carry inherent risks, which the customer acknowledges having been informed of.

7. Intellectual Property

All content on the platform (texts, photographs, logos, tour descriptions) is the property of FlexiTours or is subject to a license of use. Any reproduction, distribution, or commercial exploitation without prior written authorization is strictly prohibited.

8. Governing Law and Jurisdiction

These terms are governed by the laws in force in the province of Quebec and applicable federal Canadian laws. Any dispute shall be subject to the exclusive jurisdiction of the courts of the judicial district of Quebec, subject to recourse available before consumer protection bodies.

9. Amendments

FlexiTours reserves the right to modify these terms at any time. Amendments take effect upon publication on the platform. It is your responsibility to consult this page regularly. Continued use of the service after any modification constitutes acceptance of the updated terms.
